Buying, Selling and Settling Property – Who Is Involved?
When buying, selling and settling property there are many factors to consider in ensuring the transaction is legal and efficient for both parties. You must also be vigilant in complying with legislation and correct procedures to ensure the settlement process is compliant. Many professionals will be involved in the sale or purchase of your property and it can be overwhelming to deal with several different people in what you may have first thought to be a simple ‘sign and hand it over’ transaction.
Kate from Clarity Conveyancing has over 14 years of experience associating and working with the different professionals and experts that you will need to consult with to sell or buy your home. As a Certified Practising Conveyancer and a passionate enthusiast for customer service, Kate will ensure your property settlement questions are answered quickly and correctly.
Some of the professionals and experts involved in the sale of your home will include:
- Real Estate Agent
- New Homes Sales Consultant/Builder
- Finance/Mortgage Broker
- Conveyancer/Settlement Agent
Real Estate Agent
Appointed by the seller to sell the property, the Real Estate Agent is paid a commission from, and acts for, the Seller. The Agent that lists the property on the market is known as the Listing Agent. If another Agent introduces the eventual buyer to a property, they are known as the Selling Agent.
Some Real Estate Agents are commissioned by Buyers to find them the perfect property to view and possibly purchase. In this situation they work in the sole interest of the Buyer and can be known as a Buyers Rep.
Builder/New Homes Sales Consultant
If purchasing a house and land package, you will not only be dealing with a Real Estate Agent but also the company who will be building your home. You New Home Consultant will present and communicate with you on a variety of floor plans, features & benefits, assisting you to select the home/floorplan suitable to you. They will ensure a positive customer experience by setting precise expectations and informing you of the new home buying process from floorplan to handover of the keys.
Finance/Mortgage Broker and/or Banker
The Finance/Mortgage Broker and/or Banker is the person responsible for arranging the loan for the purchase of the property and the discharge of the mortgage for the sale. They provide all relevant and required documentation ready to be signed when the property is bought or sold. They can also offer advice on mortgage products, interest rates and lending procedures. If you are looking to purchase a property we strongly suggest you speak with your Broker/Banker first so that you can confirm how much you can loan/what your purchase budget is.
Conveyancer/Settlement Agent
Arguably the most important person in the sale of your property, the Conveyancer (or Settlement Agent) is appointed by you to ensure your best interests in the sale or purchase of real estate. They not only liaise with you, but also the Real Estate Agent/s, the Builder, the Bank/Broker and the other Conveyancer. Ensuring and striving towards a smooth settlement. The Conveyancer will also liaise with authorities for legal documents such as Certificate of Title, inspection reports and local authorities such as the Shire/Water Corporation.
